It’s no secret that a large number of individuals use the internet to see pornography. It’s normally done behind closed doors, but how would you feel if you saw someone watching pornographic material in public? 

First, let’s understand the laws placed in India against watching porn. 

Is it Illegal to Watch Porn in Public in India? 

The Act on Information Technology (IT) was enacted in the year 2000. 

2. Penal Code of India (IPC), 

 The Protection of Children from Sexual Offenses (POCSO) Act of 2012 was enacted to protect children from sexual offenses. 

It is NOT ILLEGAL to watch porn in private: 

It is not prohibited in India to watch pornographic content in your own home or private place. 

 Indian citizens have the right to life and personal liberty under Article 21 of the Indian Constitution. In a case from 2015, the Supreme Court of India orally stated that watching porn in a private room may fall under the Constitution’s right to personal liberty. As a result, no authority can take it away from you unless you follow the legal procedure. 

 So long as you’re watching porn movies in your own home, it’s perfectly legal.  

Even if it is watched in a private space, watching or storing pornographic content that portrays child pornography, rape, or violence against women is illegal. 

 In India, there is a ban on pornography.

 In India, none of the Fundamental Rights are absolute. Every right is subject to reasonable limitations. ‘Morality and decency’ is a legal basis for restricting a person’s exercise of a basic right. On the same grounds, the Indian government attempted to ban pornographic content in 2015, but was unsuccessful, and again in 2018. 

So, the question emerged once more: if pornography is illegal in India, how is it legal to watch it privately? 

The solution to the previous question is twofold. To begin, the Internet Service Providers are responsible for enforcing the pornographic prohibition. So, if an adult citizen uses methods like VPS to gain access to pornographic websites, it is the service provider, not the adult person, who is at blame. 

 Second, the government stated that the main reason for outlawing pornography in India was to stop child pornography and pornography depicting violence against women. 

 So long as you’re not watching child pornography or porn that depicts violence against women, you’re safe. 

It should be reminded that watching a pornographic movie privately and then sharing or storing it is illegal under Indian law. 

Similar laws are placed throughout the world but despite these laws, many real stories of people watching hardcore porn in public have appeared.  

Either the perpetrator might believe that they are being discrete while watching it in a public area or they are trying to force someone else to watch it.

  • Siobhann Tighe of the BBC shares a tense experience on a London bus where she witnessed a man watching porn in public

 “It had been a long and exhausting day at work. It was cold and drizzly as I boarded the bus at 7.30 p.m. The passengers were all wearing heavy coats, hoods, and hats. 

 The bus was dimly lit inside, and I expected to drift off on my trip home: just let the day go and shut off. 

 I sat next to a complete stranger on the lower deck and didn’t think twice about it. I was simply relieved to be seated. My attention was caught to my neighbor’s phone as we drove through London traffic. I wasn’t being nosy, but in the faint light of the room, I couldn’t help myself. 

Despite the fact that I didn’t mean to or want to, I found myself gazing over at his phone a few times before realizing what was going on. Next to me, a man was viewing porn in public.

My eyes continued getting drawn back to it once I realised it, even though I didn’t mean to. I couldn’t believe my eyes. He began by viewing animated porn, in which two naked creatures dressed in garish colours repeated their moves again and over. Then he began watching a movie that seemed to start in a gas station with a huge woman in a low-cut yellow top gazing into the driver’s window. 

Perhaps because his hoodie obscured his peripheral vision, the man didn’t seem to catch my glances at his phone. He seemed completely indifferent to me and those around him, who admittedly couldn’t see what I saw. 

We soon arrived at his bus stop, and he motioned for him to go because he had the window seat and I had the aisle, and he muttered a “thank you” as he pushed past me. I stood there watching him exit the bus and stroll down the street. 

I was insulted in my heart. I was annoyed and uncomfortable, but I did nothing about it.” 

  • Recent events: 

LONDON — A British legislator who had been suspended from Prime Minister Boris Johnson’s Conservative Party announced his resignation on Saturday after confessing to watching pornography on his phone twice in the House of Commons “in a fit of craziness.” 

 Neil Parish was suspended by the Conservatives on Friday after reporting himself for watching porn in public to parliament’s standards commissioner. 

 Parish resigned on Saturday, despite previously stating that he would remain in parliament while an investigation was conducted. 

In a sad interview with the BBC on Saturday, Parish said, “In the end, I could see that the furore and the damage I was inflicting my family and my constituency association, it just wasn’t worth keeping on.” 

Parish, a farmer, said he came on the explicit material by accident when searching for tractors on a website with a similar name, and that he then “watched it for a bit which I shouldn’t have done.” 

“But my offence, my most serious crime, was that I went in a second time, and this time it was on purpose. On the other side of the room, people were queuing to vote.” 

 When asked what had been on his mind, he described it. 

When asked what was going through his head, he described it as “a wild moment.” 

 A female minister said she saw a male colleague viewing pornographic material while sitting behind her in the Commons chamber and the same member watching pornography during a committee meeting earlier this week, according to British media. 

 “I wasn’t proud of what I was doing,” Parish admitted, adding that he didn’t intend for others to see it. 

 “I’m not going to defend my actions. What I did was completely incorrect… I believe I must have lost all sense of reality.” 

  • After being caught watching porn at Wendover Secondary School, a teacher was fired in the UK.

After being spotted watching porn at a school in Wendover, a supply teacher has been barred from the profession. 

Samuel Kin On Wong used a computer at John Colet School in Wendover to obtain X-rated material. 

Before a panel meeting organised by the Secretary of State for Education on December 7, Wong admitted to the wrongdoing. 

As a consequence of the investigation, Wong has been prohibited from teaching for at least the next five years. 

Wong has until December 15, 2026 to file an appeal of the verdict. 

This means he won’t be able to work in any educational institution in England for the next five years. 

On October 6, 2020, the 60-year-old entered pornographic websites while using Bucks school equipment. 

The Teaching Regulation Agency (TRA) panel discovered that he was watching pornographic information during a ‘teaching day.’ 

Wong admitted to professional misconduct that was either improper or could bring the profession into discredit. 

He had barely been at the school for five days when he made his rash Google search. 

On the next day, he was expelled from school, and the TRA opened an inquiry on October 26 of that year. 

The inappropriate internet surfing that day was detected by the school’s eSafe software security. Wong’s scheduled appointment with the Wendover school on the next day was cancelled. 

“The panel noticed multiple occasions in the bundle when Mr Wong openly admitted his conduct and the access to adult pornography was backed by technical and documentary evidence,” according to the TRA report. 

“Whilst the panel considered that no kids were present at the time of the incident, the panel did assess that as a teacher Mr Wong was likely to be perceived as a role model by pupils,” a TRA spokeswoman added. 

“The panel considered Mr Wong’s actions would likely harm the public’s impression of teaching, and there were public interest concerns to consider,” says the report. 

The panel also discussed the potential repercussions of Wong’s actions on the whole teaching profession in this country. 

The fact that Wong submitted his apologies in writing, implying that the panel was unable to assess his depth of remorse, was also considered. 

  • On buses and trams in Manchester, women have spoken out about a series of “insidious” instances involving a man watching porn in public and ‘getting off’ on their reactions. 

The Manchester Evening News spoke to six women over the course of a year, from November 2021 to last week, who all claim to have been targeted by this individual.

All of the women described how the man would sit in front of them, position his phone in such a way that they couldn’t help but see the videos, and play increasingly explicit porn in public, while either looking behind him or viewing their reactions in the reflection of his phone screen – possibly even recording them. During the encounter, two of the women said he appeared to be, or was actively stroking himself. 

“When it first started, we were like, ‘Surely this isn’t happening,'” said students Eva and Isobel*, who witnessed the man watching porn in public on the 143-bus last Tuesday. 

“We were laughing because we were shocked and trying to make a comedy out of it.” We became increasingly uneasy as the situation progressed. We reasoned that he was staring at us strangely; what if he got off at the same stop as us? “It’s past midnight.” 

Eva and Isobel came across a Facebook post on the same night made by Megan*, a woman who experienced virtually exactly the same event as them. They communicated and discovered that neither instance was unique. 

The women reported their ordeal to the police, who stated that they are investigating the occurrences in conjunction with TfGM and Stagecoach. 

“I believe it’s completely wrong for someone to do that, and it’s happened to a lot of individuals,” Isobel stated. 

Megan sat two rows behind the man on the 143 bus on the same evening, with another two women in front of her. She replicated a pattern of behaviour similar to Eva and Isobel’s: he began by watching unusual but not particularly graphic ‘fart’ porn, then advanced to watching increasingly violent movies, always looking behind him to gauge her reaction. 

Megan thought it was “strange” when he got up and took their seats in the row in front of her, getting closer to her, after the women in front of her left the bus. 

She explained, “I didn’t feel scared until he sat closer to me.” She returned home and decided to ask others whether they had had similar experiences, so she created a Facebook post in which others, including Eva and Isobel, opted to share their stories. 

“What made me even more terrified was the fact that so many people had seen it.” “This has had such an impact on so many people,” she remarked. 

  • Jordan: A taxi driver has been arrested for watching porn in public. 

According to local media, a taxi driver in Jordan was detained after he was caught watching a pornographic film inside his vehicle. 

After a video of a taxi driver watching porn in his vehicle went viral on social media, the Governor of Aqaba, Muhammad Al Rafaia, ordered his arrest. It was recorded when he played the video clip inside his vehicle. 

According to Rafaia, security forces initiated an inquiry into the incident right after and apprehended the cab driver, who will be referred to the appropriate authorities for further legal action. 

This comes only days after two films of two different people were widely circulated on social media in Jordan, showing two guys driving their vehicles while engaging in immoral acts. 

The Cyber Crimes Unit of the Public Security Directorate (PSD) is monitoring any films circulating on social media, according to the PSD. 

  • People discuss their experiences of being exposed to pornography without their consent. 

Other social media users (mainly women) recounted seeing porn in public being freely viewed by coworkers, clients, and fellow commuters. Female pals shared stories on WhatsApp about males they worked with who were viewing explicit sex in the office. I also discovered that long-buried memories were surfacing. 

When I was in my mid-twenties and working as a staff writer for a daily newspaper, it happened more than once, but the one that sticks with me took place late at night at the office.

Before I noticed limbs, backsides, and open lips mirrored in a window on the opposite side of the room, I was alone – or believed I was alone. In the glass, there is a computer screen. In a puddle of light, a familiar face appears. The sounds were muted but distinct. 

Was he aware that I was present? I believe he did. This wasn’t the first time it had happened, and I wasn’t the only one who had noticed his strange chevalier. The individual was well beyond my pay grade and a close associate of the company’s top executive. He was drunk most of the time and had previously made obscene comments to me. He knew he could do whatever he wanted. 

Aside from the fact that it was unpleasant and awkward? The answer was that it seemed like one of the more innocuous offences that occurred in that office at the time. They take place in dysfunctional, male-dominated businesses with strict hiring policies. They are frequently committed by persons who believe they are unstoppable.

Because of the slower connections in such cafes, I’ve observed people watching porn in public, primarily still images rather than films. Customers and owners of the cafés didn’t seem to mind if others were upset by such online activity. 

  • The policy of New York public libraries enabling patrons to easily view hardcore porn has infuriated religious leaders and politicians, because it allows youngsters as young as 13 to access it.

  • It comes as the British Transport Police are urging anyone who feels “uncomfortable or upset” about seeing passengers watching pornography to notify them. 

The number of train passengers arrested for watching porn on their journeys has more than tripled in the last year, according to new data released today. 

After agitated passengers saw persons watching pornographic material on smartphones and laptops, police were contacted 26 times last year, compared to 17 times in 2015. 

According to The Sun on Sunday, officers made six arrests in 2016, up from two the previous year. People are encouraged to report the British Transport Police (BTP) if they spot other passengers watching porn in public 

“We are aware that there has lately been some media talk regarding persons watching pornography on public transportation and whether transportation groups or the police can do anything about it,” a BTP spokesman stated. 

He said, ” “We want you to tell us if someone on the train makes you feel uncomfortable or upset because they’re looking at pornography. 

“In some cases, legislation such as railway bylaws or Section 5 of the Public Order Act for causing harassment, alarm, or distress could be utilized to prosecute this type of behavior. 

  • I remember sitting in the back of a lecture as a graduate student, assiduously taking notes on modal verb morphology, when I noticed the guy in the seat in front of me, and slightly below, was watching porn in public on his phone. 

It was odd for two reasons: first, it was the first time I’d seen such technology in a phone, and it was at a period when the Motorola Razr flip-phone was the phone to have. Second, why was he watching porn while giving a lecture, watching porn in public?

It wasn’t even a clip. It was a full-length scene, and he watched it from beginning to end, which meant that I did as well, albeit inadvertently. He wasn’t on his own. Until recently, I could see a young woman’s phone reflected in the window of a London tube train and know she was browsing her private Tumblr, her filthy Tumblr, as clear as day.

  • Bengaluru: A 31-year-old woman journalist has filed a police complaint in Bengaluru’s Banaswadi neighbourhood, alleging that a scooter-riding male asked her for an address, then flashed his private parts and began masturbating in front of her. 

According to the complaint, she was on her way home from the store about 10 a.m. on Saturday when a man on a scooter stopped next to her and asked for an address. She observed that his one hand was down as she was giving him directions. The offender had unzipped his pants, but the victim was unaware of it. 

As a woman yells at the accused, he flees. 

The harmed woman was looking at the accused man’s face while guiding him when he displayed his private parts at her and began masturbating, according to Bangalore Mirror. When the woman yelled at him, he swiftly rode away on his scooter. He was wearing a mask and a helmet, so she couldn’t see his face. Nobody was around at the time of the incident, according to the woman. 

Police examine CCTV footage in order to identify the suspects. 

The Ramamurthy Nagar Police Department combed through CCTV footage for leads on the suspect. According to BM, a top police official said that they have obtained some information about the accused and that efforts are being made to locate him.
